London Party Wall Surveyors serves Uxbridge from Fitzrovia. Send the property address and drawings so we can assess the party wall, boundary and excavation elements. Our Hillingdon service page explains the information to prepare.
Check the work, not the age of the house
A loft or extension may involve cutting into a party wall, a new wall at the line of junction, or foundations near a neighbouring structure. The actual work and ownership matter; a postcode or house style alone does not establish the notice requirement.
Excavation near a neighbouring building
Within 3 metres, section 6 depends on excavation below the neighbouring foundations. Within 6 metres, it depends on whether the work meets the statutory plane drawn down at 45 degrees from the neighbouring foundations towards the excavation.
Provide the excavation sections, proposed foundation depth, adjoining addresses and available information about neighbouring foundations. A detached house can still fall within section 6.
Notice and response
For party structure and excavation notices, absence of written consent within 14 days triggers the dispute procedure. Section 1 new-wall notices have different consequences. Where a dispute arises, owners appoint an agreed surveyor or separate surveyors; section 10(4) addresses refusal to appoint and neglect for ten days after a written request.
Before starting the relevant works, check that the statutory notice period has expired or an earlier start has been agreed, and comply with the award and other required permissions.
Condition records and costs
A pre-works schedule of condition is a useful baseline, commonly prepared during the surveyors' process. The Act does not expressly require one for every project. It can also be arranged following consent without an award.
The building owner normally pays reasonable dispute costs, but the surveyors determine their allocation under section 10(13). Check the written appointment terms and fee arrangements before instruction.
For typical homeowner projects, published building-owner fees are £100 for a notice, £500 for a schedule and £800 for an award, per adjoining owner. Complex work and disbursements can cost more. Additional Awards on the same project are charged at 50% of the standard fee. Confirm the scope and fee before instruction.
